Web Privacy Policy

May 2015

Web Privacy Policy
This privacy notice, pursuant to Article 13 of Legislative Decree 196/2003 (hereinafter the “Privacy Code”), describes how this website, owned by Benussi Marine S.r.l., is managed with regard to the processing of the personal data of users who browse it, also in accordance with the provisions of the Italian Data Protection Authority’s Decision of 8 May 2014, “Identification of simplified procedures for the information notice and the acquisition of consent for the use of cookies” (hereinafter the “Decision”).
This notice applies only to the above-mentioned website and not to any other websites or sections/pages/areas owned by third parties that the user may consult via specific links available on this website.

1. TYPES OF DATA PROCESSED AND PURPOSES OF THE PROCESSING

1.1. Browsing data
The IT systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.
This information is not collected to be associated with identified data subjects, but by its very nature it could, through processing and association with data held by third parties, allow the identification of users connecting to the website. The data collected include IP addresses or domain names of the computers used by users, the URI (Uniform Resource Identifier) addresses of requested resources, the time of the request, the method used to submit the request to the server, the size of the file returned in response, the numeric code indicating the status of the server’s response (successful, error, etc.), and other parameters relating to the user’s operating system and IT environment.
These data are processed for the time strictly necessary to achieve the purposes for which they are collected, solely in order to obtain anonymous statistical information on the use of the website (accesses) and to check its correct functioning.
The data may be used to ascertain liability in the event of possible computer crimes to the detriment of the website.

1.2. Data provided voluntarily by the user
If users of this website are required, in order to access certain services, to provide their personal data, a specific and detailed notice on the relevant processing will be provided in advance on the pages relating to each individual service, pursuant to Article 13 of the Privacy Code, specifying the limits, purposes, and methods of the processing.

1.3. Cookies

What are cookies?
Cookies are small text files that the website visited by the user sends to the user’s device (usually the browser), where they are stored so that the device can be recognized on the next visit. On each subsequent visit, cookies are sent back from the user’s device to the website.
Each cookie generally contains: the name of the server from which the cookie was sent; its expiry date; and a value, usually a unique number generated randomly by the computer. The website server that transfers the cookie uses this number to recognize you when you return to visit a website or browse from one page to another.
Cookies may be installed not only by the operator of the website visited by the user (first-party cookies), but also by a different website that installs cookies via the first website (third-party cookies) and is able to recognize them. This happens because the visited website may contain elements (images, maps, sounds, links to web pages of other domains, etc.) that reside on servers different from that of the visited website.
Depending on their purpose, cookies are divided into technical cookies and profiling cookies.
Technical cookies are those used solely for “carrying out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service” (see Article 122(1) of the Privacy Code, as amended by Legislative Decree 69/2012). In particular, these cookies are usually used to enable efficient navigation between pages, store user preferences (language, country, etc.), perform IT authentication, manage the shopping cart, or enable online purchases, etc. Some of these cookies (so-called essential or strictly necessary) enable functions without which certain operations would not be possible. Pursuant to Article 122(1) of the Privacy Code, the use of technical cookies does not require user consent.
So-called analytics cookies are also treated as technical cookies when used directly by the website operator to collect aggregated information on the number of users and how they visit the website. These cookies help owners and/or operators understand how users interact with the website’s content in order to optimize it.
Profiling cookies are used to track the user’s browsing, analyze behavior for marketing purposes, and create profiles of tastes, habits, choices, etc., in order to send targeted advertising messages in line with the user’s interests and preferences expressed during online browsing. These cookies may be installed on the user’s device only if the user has given consent through the simplified procedures indicated in the Decision.
Based on their duration, cookies are divided into persistent cookies, which remain stored on the user’s device until they expire (unless removed by the user), and session cookies, which are not stored persistently and disappear when the browser is closed.

c. Profiling cookies.
Third-party profiling cookies
While browsing this website, the user may receive profiling cookies on their device installed and managed by third parties in order to send advertising messages consistent with the preferences expressed by the user during online browsing. This happens because, as indicated above, the website may contain elements hosted on servers different from the one hosting the visited website. Where third parties set cookies while you visit this website, they obtain information related to the fact that users have visited it. Further information on the use of cookies is available by accessing the link indicated below on the third party’s website. Refusing consent to the use of third-party profiling cookies does not affect the possibility to access the website.
Below we provide the names of third-party cookies that may be installed via the website, their purpose, the third party’s name, and the link to the third party’s privacy notice.
