Benussi Marine S.r.l. guarantees the right of withdrawal from the purchase contract for any reason.

To exercise this right, the Customer must send a registered letter with return receipt (Raccomandata A/R) and preferably also an email to info@benussimarine.com or a fax, specifying the order number and the products to be returned. This must be done within 14 calendar days from receipt of the goods.

The right of withdrawal is subject to the following mandatory conditions:

1. Pursuant to Article 64 and following of Legislative Decree No. 206/2005, if the Customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity, or who does not indicate a VAT number in the order form submitted to Benussi Marine S.r.l.), they are entitled to withdraw from the purchase contract for any reason, without any penalty.

2. The purchased item must be returned unused and in perfect condition, in its original packaging complete in all its parts (including packaging, documentation, and accessories such as manuals, cables, etc.). No labels or adhesive tape must be applied directly to the original product packaging, which must be placed inside a second outer box. Products that have been used or show signs of damage or dirt will not be accepted.

3. In accordance with the law, return shipping costs are borne by the Customer. Returns of products that are not intact, are damaged, or lack original accessories and components will not be accepted and will be sent back to the sender with additional shipping costs charged.

4. The shipment, until confirmed as received in our warehouse, is under the Customer’s full responsibility. We are not liable for any damage, theft, or loss of returned goods sent via uninsured or untracked shipping methods (e.g., standard mail).

5. In the event of damage during transport, we will promptly notify the Customer (within 5 working days of receipt of the goods) to allow them to file a claim with the courier they selected and obtain reimbursement for the value of the goods (if insured). In this case, the product will be made available to the Customer for return, and the withdrawal request will be canceled.

6. If the returned goods are received intact and compliant with the above conditions, we will refund the cost of the goods only (excluding shipping costs) by reversing the charge to the credit card used or by bank transfer within 14 calendar days from receipt of the return.

For any disputes between the parties, jurisdiction shall lie with the Court of the place where the contract is performed.
